In Pennsylvania, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to promote public health and safety. Key requirements include:

 

Medical Oversight:

Individuals or entities acquiring an AED must obtain approval from a licensed physician.

 

Training:

Expected AED users are required to complete training in the use of AEDs and cardiopulmonary resuscitation (CPR). This training should be provided by the American National Red Cross, the American Heart Association, or an equivalent program approved by the Pennsylvania Department of Health in consultation with the Pennsylvania Emergency Health Services Council.

 

Emergency Medical Services (EMS) Notification:

It is recommended that owners of AEDs notify local EMS providers or 911 centers about the existence and location of the devices to facilitate prompt emergency response.

 

Maintenance Program:

AEDs must be maintained and tested according to the manufacturer’s operational guidelines to ensure their readiness during emergencies.

 

Use Protocol:

In the event of using an AED, the user is required to immediately contact emergency medical services. Any pertinent information must be made available to EMS personnel or other healthcare providers as needed.

 

Good Samaritan Protection:

Pennsylvania law provides immunity from civil liability for individuals and entities who, in good faith, use an AED in an emergency. This protection extends to:

  • Rescuers
  • Purchasers
  • Property owners
  • Physicians
  • Trainers

 

This immunity does not cover acts of gross negligence or willful or wanton misconduct.

 

Placement Requirements:

Health Clubs: Legislation requires that health clubs offering services during nonstaffed hours be equipped with an AED, panic button, emergency phone, and personal security device.

Schools: Act 35 mandates that nonpublic schools purchasing AEDs through the Commonwealth’s program submit information on the number and placement of the devices.

 

These regulations aim to encourage the availability and proper use of AEDs, thereby enhancing emergency response efforts across the state.
