In Texas, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to enhance public health and safety. Key requirements include:
Medical Oversight:
Entities or individuals acquiring an AED must ensure that a licensed physician provides medical oversight to ensure compliance with training, emergency medical services (EMS) notification, and maintenance requirements.
Training:
While Texas law previously mandated that expected AED users receive training in cardiopulmonary resuscitation (CPR) and AED use from organizations such as the American Heart Association or the American Red Cross, recent legislation (SB 199) has removed this requirement. However, training is still highly recommended to ensure effective response during emergencies.
Maintenance Program:
Owners of an AED are required to maintain and test the device according to the manufacturer’s guidelines. This includes conducting monthly inspections to verify that the AED is in its designated location, ready for use, and not damaged in a way that could prevent operation.
Emergency Medical Services (EMS) Notification:
Upon acquiring an AED, the owner must notify the local EMS provider of the existence, location, and type of AED. Additionally, if the AED is used to provide emergency care to a person in cardiac arrest, the user must promptly notify the local EMS provider.
Good Samaritan Protection:
Texas law provides immunity from civil liability for individuals and entities who, in good faith and without compensation, use an AED to provide emergency care. This protection extends to:
- Rescuers
- Purchasers
- Physicians
- Trainers
This immunity does not cover acts of willful or wanton negligence.
Placement Requirements:
Schools: Texas law mandates that each school district and private school develop safety procedures to respond to medical emergencies, which include the availability of AEDs at each campus. An AED must be present at all large student gatherings, and an employee trained in AED use must be present during such events.
