In Tennessee, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to enhance public health and safety. Key requirements include:

 

Medical Oversight:

Entities or individuals acquiring an AED must ensure that a licensed physician or medical authority is involved in the program to provide medical oversight.

 

Training:

Expected AED users are required to complete training in cardiopulmonary resuscitation (CPR) and AED use. This training should be provided by organizations such as the American Heart Association or an equivalent nationally recognized course.

 

Maintenance Program:

The AED must be maintained and tested according to the manufacturer’s operational guidelines to ensure its readiness during emergencies.

 

Emergency Medical Services (EMS) Notification:

Entities that acquire an AED are encouraged to register the existence and location of the device with the local emergency communications district or the primary provider of emergency medical services.

 

Use Protocol:

In the event of using an AED, the user must activate the emergency medical services system as soon as possible.

 

Good Samaritan Protection:

Tennessee law provides immunity from civil liability for individuals and entities who, in good faith and without compensation, render emergency care using an AED. This protection extends to:

  • Rescuers
  • Purchasers
  • Property owners
  • Physicians
  • Trainers

 

This immunity does not cover acts of gross negligence or willful or wanton misconduct.

 

Placement Requirements:

Schools: The Smart Heart Act, signed into law in May 2024, requires all public and nonpublic schools serving grades nine through twelve to maintain at least one AED that is accessible during the school day and all school athletic activities. Additionally, these schools must establish, review, and annually practice an athletics emergency action plan for responding to students who sustain cardiac arrests or other life-threatening injuries while participating in school athletic activities.

 

These regulations aim to encourage the availability and proper use of AEDs, thereby enhancing emergency response efforts across the state.
