In South Carolina, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to enhance public health and safety. Key requirements include:

 

Training:

Entities or individuals acquiring an AED must ensure that designated users receive current training in cardiopulmonary resuscitation (CPR) and AED use. This training should be provided by organizations such as the American Heart Association, American Red Cross, American Safety and Health Institute, or National Safety Council, or through programs that meet or exceed the standards of these organizations.

 

Maintenance Program:

The AED must be maintained and tested according to the manufacturer’s operational guidelines. Owners are required to keep written records of all maintenance and testing activities to ensure the device’s readiness during emergencies.

 

AED Liaison:

Entities that acquire an AED must appoint a healthcare professional to serve as the AED liaison. This liaison is responsible for overseeing the AED program, which includes CPR and AED training, establishing protocols or guidelines, deployment strategies, and equipment maintenance plans.

 

Use Protocol:

In the event of using an AED, the user must activate the emergency medical services (EMS) system or call 911 as soon as possible. Additionally, any clinical use of the AED must be reported to the AED liaison for review.

 

Good Samaritan Protection:

South Carolina law provides immunity from civil liability for individuals and entities who, in good faith and without compensation, render emergency care using an AED. This protection extends to:

  • Rescuers
  • Purchasers
  • Physicians
  • Trainers

 

This immunity does not cover acts of gross negligence in the application of the AED.

 

Placement Requirements:

Schools: South Carolina law mandates that each high school implement an AED program. This includes having at least one AED on the premises and ensuring that designated personnel are trained in its use.

 

These regulations aim to encourage the availability and proper use of AEDs, thereby enhancing emergency response efforts across the state.
