In Ohio, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to enhance public health and safety. Key requirements include:

 

Training:

Individuals or entities possessing an AED are encouraged to have expected users complete a course in automated external defibrillation and cardiopulmonary resuscitation (CPR) offered or approved by a nationally recognized organization. While training is recommended, it is not mandatory for AED use.

 

Maintenance Program:

Owners of an AED must maintain and test the device according to the manufacturer’s guidelines to ensure its readiness during emergencies.

 

Emergency Medical Services (EMS) Notification:

It is recommended, but not required, that individuals or entities possessing an AED notify a local EMS organization of the AED’s location.

 

Use Protocol:

Any person may perform automated external defibrillation. Training in AED use and CPR is recommended but not required. If an AED is used, the user should make a good faith effort to activate or have another person activate the emergency medical services system as soon as possible, unless the AED is used as part of an EMS system or in a hospital setting.

 

Good Samaritan Protection:

Ohio law provides immunity from civil liability for individuals who, in good faith and without compensation, render emergency care using an AED. This protection extends to:

  • Rescuers
  • Physicians involved in AED programs
  • Individuals providing AED training

 

This immunity does not cover acts of willful or wanton misconduct.

 

Placement Requirements:

Schools and Sports Facilities: As of July 2024, Ohio law requires that automated external defibrillators (AEDs) be placed in every public and chartered nonpublic school, as well as all municipally owned or operated sports and recreation locations. Schools are also required to adopt emergency action plans for the use of AEDs and practice these plans quarterly.

 

These regulations aim to encourage the availability and proper use of AEDs, thereby enhancing emergency response efforts across the state.
