In Illinois, the deployment and use of Automated External Defibrillators (AEDs) are governed by comprehensive legislation aimed at enhancing public safety and encouraging the availability of these life-saving devices. Key requirements include:

 

Training:

Individuals expected to use an AED must successfully complete a course in cardiopulmonary resuscitation (CPR) and AED use that is certified by a nationally recognized organization, such as the American Heart Association or the American Red Cross.

 

Emergency Medical Services (EMS) Notification:

AED owners are required to notify an agent of the local emergency communications or vehicle dispatch center of the existence, location, and type of AED acquired.

 

Maintenance Program:

AEDs must be maintained and tested according to the manufacturer’s guidelines to ensure proper functionality.

 

Use Protocol:

Any person who uses an AED in an emergency must activate the EMS system as soon as possible and report any clinical use of the AED to the appropriate medical authority.

 

Good Samaritan Protection:

Illinois law provides immunity from civil liability for individuals and entities who, in good faith and without compensation, render emergency care using an AED. This protection extends to:

  • Physicians who authorize the purchase of an AED.
  • Individuals or entities providing AED training.
  • Owners, occupiers, or managers of premises where an AED is located.
  • AED users.

 

This immunity does not cover acts of willful or wanton misconduct.

 

Placement Requirements:

Physical Fitness Facilities: Illinois mandates that all physical fitness facilities, both indoor and outdoor, must have at least one operational AED on the premises. Additionally, these facilities are required to ensure that there is a trained AED user present during all physical fitness activities.

Police Departments and Sheriff’s Offices: Each police department and sheriff’s office in Illinois is required to have an AED on-site to enhance emergency response capabilities.

Educational Institutions: Beginning with the 2014-2015 school year, training on how to properly administer CPR and use an AED has been included as a part of the curriculum in all secondary schools in Illinois.

Dental Offices: Dental offices that administer anesthesia or sedation are required to have an AED on the premises to ensure patient safety during procedures.

Horse Racing Facilities: Licensed horse racing facilities in Illinois are mandated to have at least two operational AEDs accessible when backstretch workers are present. One AED must be placed in the paddock area, and another on the backstretch of the racing facilities.

 

These regulations are designed to promote the widespread availability and proper use of AEDs, thereby enhancing emergency response efforts and improving survival rates for sudden cardiac arrest incidents across Illinois.
