In Delaware, the deployment and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to promote public health and safety. Key requirements include:

 

Training:

Prospective AED users must receive appropriate training from recognized organizations such as the American Red Cross, the American Heart Association, the Delaware State Fire School, or another nationally recognized provider of CPR and AED training approved by the State EMS Medical Director.

Maintenance Program:

AEDs must be maintained and tested according to the manufacturer’s guidelines on a regularly scheduled basis to ensure proper functionality.

 

Emergency Medical Services (EMS) Notification:

Any person who uses an AED to render emergency care must notify the appropriate EMS units as soon as possible and report any clinical use of the AED to the relevant licensed physician or medical authority.

 

Good Samaritan Protection:

Delaware law provides immunity from civil liability for individuals and entities who, in good faith and without compensation, render emergency care using an AED. This protection extends to:

  • Individuals who use an AED in an emergency.
  • Entities that provide AED training.
  • Persons or entities responsible for the site where the AED is located.

 

This immunity does not cover acts of willful or wanton misconduct or gross negligence.

 

These regulations aim to encourage the availability and proper use of AEDs, thereby enhancing emergency response efforts across the state.
