AED LAWS & REQUIREMENTS IN ARIZONA
In Arizona, the acquisition and use of Automated External Defibrillators (AEDs) are governed by specific statutes designed to promote public safety and encourage the availability of these life-saving devices. Key requirements include:
Medical Oversight:
Entities or individuals acquiring an AED must enter into an agreement with a licensed physician who will oversee all aspects of the AED program, including training, maintenance, and usage protocols.
Training:
While Arizona law does not mandate specific training requirements for AED users, it is recommended that potential users complete a state-approved course in cardiopulmonary resuscitation (CPR) and AED use to ensure effective response during emergencies.
Emergency Medical Services (EMS) Notification:
Any trained responder who uses an AED during a sudden cardiac arrest emergency is required to alert EMS by calling 911 as soon as possible.
Maintenance Program:
Owners of AEDs must ensure that the devices are properly maintained and tested on a regular basis in accordance with the manufacturer’s guidelines to guarantee their readiness during emergencies.
Post-Use Reporting:
After an AED is used, the owner is required to submit a written report to the Bureau of Emergency Medical Services and Trauma Systems within the Arizona Department of Health Services within five working days.
Good Samaritan Protection:
Arizona law provides immunity from civil liability for individuals and entities involved in the acquisition and use of AEDs, including:
- Physicians providing oversight.
- Individuals or entities providing training in CPR and AED use.
- Owners of the property or facility where the AED is located.
- Good Samaritans who use an AED to render emergency care in good faith and without compensation.
This immunity does not cover acts of willful misconduct or gross negligence.
Placement in State Buildings:
Any state building in Arizona that is constructed or undergoes major renovation at a cost of at least $250,000 is required to be equipped with AEDs.
These regulations aim to encourage the widespread availability and proper use of AEDs, thereby enhancing emergency response efforts and improving survival rates for sudden cardiac arrest incidents across the state.
